Terms of sale

World Trust Pharmacy is the online pharmacy of the C S Medical Store pharmaceutical logistics group. The following terms and conditions (the "Terms of Sale") related to the services and sales as between the World Trust Pharmacy (the "Pharmacy") and you (the "Customer") of the products and services (the "Products" or "Ordered Products") ordered by the Customer from the Pharmacy.

By accepting delivery of the Products described on their order, the Customer agrees to be bound by and accepts these Terms of Sale.

THESE TERMS & CONDITIONS APPLY TO ALL TRANSACTIONS, BOTH CURRENT AND FUTURE, INVOLVING THE PURCHASE OF PRODUCTS FROM THE PHARMACY. IF THE CUSTOMER DOES NOT AGREE TO THESE TERMS & CONDITIONS, WORLD TRUST PHARMACY, AS THEIR AUTHORIZED AGENT, WILL NOT BE ABLE TO FACILITATE THE PURCHASE OF THEIR PRODUCTS.

  1. Prescription Required

World Trust Pharmacy will not accept any Order unless the customer delivers a copy of the Prescribing Practitioner's original prescription to World Trust Pharmacy or unless World Trust Pharmacy receives a copy of the original prescription from the Prescribing Practitioner by facsimile, post or email.

The Customer's Prescription has not been altered with in any way, nor has it been filled prior to submission to World Trust Pharmacy.

  1. Personal Examination

The Customer understands that it is their responsibility to have their prescribing physician ("Their own Physician") conduct regular physical examinations, including any and all suggested testing, to ensure that they have no medical problems which would constitute a contraindication to the Customer taking the ordered products.

The Customer certifies that they have had a physical examination by Their Own Physician within the last twelve (12) months from the date hereof.

The Customer is of the age of majority in the jurisdiction in which they normally reside (“the Place of Residence”) and are not restricted from making their own medical decisions on the laws of their Place of Residence.

The Customer is not seeking or relying on any medical information from World Trust Pharmacy and the Customer has consulted a qualified physician licensed where they obtained the prescription within the last year.

  1. Power of Attorney

The Customer authorizes and appoints World Trust Pharmacy as their agent and attorney, to take all steps, sign all documents, and act on their behalf as if they were personally present and acting for themselves for the limited purposes of obtaining a legally valid prescription, if required by applicable law, for any prescription which they have sent to the Pharmacy; and (b) packaging the Products and delivering them to them. This authorization shall include, but not be limited to, the collection of their personal and personal health information and the disclosure of such information to the Pharmacy and any other health professionals being retained on their behalf, as required. The Customer may revoke this authorization at any time, but it shall continue until the Customer revokes it in writing.

  1. Prices, Orders and Payment Terms

The prices for the Products shall be as specified by the Pharmacy and as set forth in our website as at the time of acceptance of an order. Prices for Products shall be subject to change without further notice.

No contract of sale is formed between World Trust Pharmacy and the customer unless and until the order is accepted by World Trust Pharmacy by shipping or arranging to ship the order.

World Trust Pharmacy are required to collect order information and/or payment in order to fulfill the Customer order. Orders are not binding upon the pharmacy, until accepted in writing.

The Customer will immediately contact Their Own Physician in the event they suffer any unexpected site effects from any of the Ordered Products.

Credit terms are at the discretion and as specified by the Pharmacy and implemented, and unless otherwise specified in writing, payment must be received by World Trust Pharmacy prior to acceptance of an order.

Payment for the Order may be made by a credit card accepted by World Trust Pharmacy, wire transfer, bank draft, personal cheque or money order.

In the event the Customer's payment is not authorized, World Trust Pharmacy has the right to cancel the Customer's order and attempt to provide the customer with notice of such cancellation.

  1. Shipping Charges and Taxes

Separate charges for shipping and handling will be shown on the invoice(s). The Customer is responsible for services tax, sales and all other taxes associated with the Order, however designated, as required by the jurisdiction of the sale.

Delivery of the Product to the Customer takes place when the product leaves the Pharmacy. After delivery, the Pharmacy will, as attorney and agent for the Customer, arrange for shipping of the product to the Customer's home address.

Normally, the Customer's product shipment takes an average of 10-14 business days to arrive.

World Trust Pharmacy is not liable for any refunds or damage to the Customer, due to delay in shipment or failure of the product to arrive within 21 business days.

6.  Warranties

THE CUSTOMER ACKNOWLEDGES THAT THE MANUFACTURERS OF THE PRODUCTS ARE SOLELY RESPONSIBLE FOR ANY WARRANTY ASSOCIATED WITH THE PRODUCTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORLD TRUST PHARMACY DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, IN RESPECT OF THE PRODUCTS AND SERVICES CONTEMPLATED BY THESE TERMS & CONDITIONS, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

RESPONSIBILITY FOR CLAIMS IN RESPECT OF THE PRODUCTS IS LIMITED TO REPLACEMENT OF THE PRODUCTS.

7. Governing Law

Title to the Customer's medications passes from the Pharmacy to the Customer when the Customer's medications leave the Pharmacy. All agreements reached or contracts formed with the Pharmacy shall be deemed to have been made in India where the ordered products are shipped from and the laws of India shall have sole and exclusive jurisdiction over any dispute arising between the Customer and the Pharmacy and that the courts of India shall have sole and exclusive jurisdiction over any such dispute.

  1. Privacy Policy

The Customer shall fully and accurately disclose their personal information and consent to its use by World Trust Pharmacy. By submitting an Order to the Pharmacy, the Customer consents to the collection and use of personal information as described in our Privacy Policy.

World Trust Pharmacy reserves the right to amend the Privacy Policy from time-to-time by posting and updating the Privacy Policy on the Website. The Customer agrees to review the Privacy Policy each time they submit an order for Products.

  1. Returns Policy

Please refer to the returns policy for complete details. World Trust Pharmacy reserves the right to amend its Returns Policy from time to time by posting the updated policy on its website. The Customer agrees to review the Return Policy each time it submits an Order.

  1. Products and Services.

World Trust Pharmacy may revise and discontinue the Products and Services displayed on the website at any time, without prior notice.

  1. Exports

By placing an Order for product or services, the Customer represents to the Pharmacy that sale, delivery and shipment of the Products will not violate any import, export or other law or regulation in the Customer's home jurisdiction.

  1. Entire Agreement

The Customer agrees that these Terms of Sale and any document incorporated by reference or referred to herein constitute the entire agreement between the Customer and World Trust Pharmacy pertaining to the subject-matter of these Terms of Sale, and supersedes, terminates and otherwise renders null and void any and all prior agreements, understandings, negotiations, contracts, proposals or requests for proposals, whether written or oral.

In the event of a conflict between these Terms of Sale and any of the documents incorporated by reference or referred to herein, these Terms of Sale shall govern.

  1. Severability

The invalidity or unenforceability of any provision of these Terms of Sale shall not affect the validity or enforceability of any other provision hereof and any such invalid or unenforceable provision shall be deemed to be severable.

  1. Headings

The section headings used herein are for convenience of reference only and do not form a part of these Terms of Sale, and no construction or inference shall be derived there from.

  1. Force Majeure

World Trust Pharmacy shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including, without limitation, delays due to back orders of requested products, mail delays, customs delays or lost shipments.

Although World Trust Pharmacy will make reasonable efforts to do so in order to maintain good client relations, World Trust Pharmacy are not responsible to notify the Customer in the event of any such delay. The Customer shall be solely responsible to make such arrangements or to purchase alternative products. Any such costs incurred in association with such purchases shall be solely borne by the Customer.

16.Ordered Products

The Ordered Products were prescribed to the Customer by a duly qualified medical practitioner (“My Physician”) in their Place of Residence, or where the Customer sought treatment and no laws have been violated in obtaining the prescription (“My Prescription”) for the Ordered Products.

The Customer will not order more than 90 days supply of prescription medication(s).

The Customer specifically acknowledges and agree that all agreements reached or contracts formed throughout the course of their purchase of their Ordered Products and also in respect due to any dispute that may arise between me and World Trust Pharmacy or My Agents shall :

a) In respect of any Ordered Products that are sold through World Trust Pharmacy, if any dispute or legal matters arise, they shall be governed by the applicable laws from where the Ordered Products were shipped and must first be held in the relevant court for it to be considered.

17. Customer disclosed information

World Trust Pharmacy will continue to rely on the information and documentation that the Customer provides to World Trust Pharmacy and the Customer represents and confirms that they have fully and truthfully disclosed all relevant information and documentation to World Trust Pharmacy. The Customer agrees to notify World Trust Pharmacy of any changes to their physical or medical condition.

By not declaring the requested patient details, medical history, medical conditions or allergies, the Customer is aware that their World Trust Pharmacy pharmacist won’t be able to check their prescriptions for accurate dosing or interaction of the prescribed drug(s) with the Customer's other medicines, allergies or medical conditions. In this scenario, the World Trust Pharmacy pharmacist may contact the Customer to gather this essential information if deemed necessary to dispense the Customer's prescription(s).

18. Disclaimer

The customer understands that :

a) By supplying the Customer's medications, World Trust Pharmacy do not undertake any responsibility, duty and liability to make any assessment of, or decisions about the Customer's medical condition or the suitability of the medications for treating the Customer's medical condition, and such responsibility, duty and liability and shall remain with the Customer and Their Physician who supplied the  prescription(s).

b) World Trust Pharmacy shall utilize the relevant licensed pharmacist to review the written prescription, Customer profile and medical history completed by the customer online or via the order form, for the purposes of independently checking that the medication(s) are appropriate for supply to the name of the person on the written prescription. The Customer agrees and acknowledges that by making such arrangements and reviewing the written prescription and the Customer's customer profile and medical history, neither World Trust Pharmacy, or the licensed pharmacist are offering or providing any medical service or advice to the Customer.

c) That the Customer agrees that child protective packaging may not be used by the Pharmacy and the Customer releases and discharges the Pharmacy and all of their officers and directors, agents and employees from any and all causes of action with respect errors or omissions by the company or agency responsible for transporting the Ordered Product to the Customer.

19. Knowledge and Consent

By placing an order with World Trust Pharmacy, the Customer has read and understands the terms and conditions as set out herein. The Customer represents that he/she consents to the Terms of Sale, and does so with full knowledge and without undue influence or duress.

The Customer acknowledges having had every opportunity to obtain independent legal advice with respect to the Terms of Sale.

The Customer confirms that they have read and understood these terms and conditions and these terms and conditions will apply to and govern any orders by the customer from World Trust Pharmacy, unless the Customer specifically indicates at the time of ordering such medications. Without limiting the forgoing, each authorization and consent provided by the Customer in this agreement will continue until the Customer cancels such authorization or consent (which the Customer can do at any time).
